Just two days after the statement by Donald Trump, the Republican presidential candidate, that both Democrats and Republicans, liberals and conservatives alike, wished for the U.S. Supreme Court to revoke the federal right to abortion care, a judge in North Dakota made a landmark decision. On Thursday, he overturned a state-level abortion ban, asserting that it infringed upon the constitutional rights of the state’s inhabitants.
According to District Court Judge Bruce Romanick, “The North Dakota Constitution ensures that every individual, including women, have the intrinsic right to make medical decisions that impact their body, health, and independence, with the guidance of a chosen healthcare provider, devoid of governmental intrusion.” He further stated that this clause particularly safeguards a woman’s right to reproductive autonomy, including the option to procure a previability abortion.
In the coming days, the nearly complete ban on abortion care will be officially nullified. The Centre for Reproductive Rights (CRR) has expressed hope that this could eventually restore access for individuals across the Midwest, where abortion care is currently prohibited in South Dakota and severely limited in surrounding states like Nebraska and Iowa.
Meetra Mehdizadeh, a CRR staff attorney who filed a lawsuit against the North Dakota ban in 2023, hailed the ruling as a victory for reproductive freedom. She stated that this makes it significantly safer for women in North Dakota to be pregnant. However, she cautioned that the Republican legislators who enacted the law have already inflicted harm on the state’s pregnant population that will require time to reverse.
Mehdizadeh noted, “The harm inflicted by North Dakota’s severe abortion bans cannot be instantly undone. North Dakota currently has no abortion clinics. This implies that most individuals seeking an abortion will still not be able to access one, despite its legality. Clinics, like any healthcare facility, require time to recruit doctors, staff, and procure equipment – they may take years to establish. The adverse consequences of abortion bans persist long after they have been overturned.”
In the lawsuit, the CRR argued that the ban was so ambiguous that it was impossible for medical providers to ascertain when an exception might be permitted for a pregnant patient whose life or health was in jeopardy.
The group stated, “Physicians providing abortions were left in a precarious position, potentially having to justify their decisions in court if their judgment was challenged. Violation of the ban was classified as a Class C felony, attracting a maximum penalty of five years in prison, a fine of $10,000, or both.”
The plaintiffs represented by the CRR included the Red River Women’s Clinic, which was the only abortion care provider in North Dakota until a previous ban forced it to move from Fargo to Moorhead, Minnesota, where abortion remained legal following the U.S. Supreme Court’s overturning of Roe v. Wade.
“Today’s ruling fills me with hope. I feel the court listened when we protested against a law that contradicted our state constitution, was too vague for doctors to interpret, and prevented them from offering the high-quality care our communities deserve,” said Tammi Kromenaker, the clinic’s director. “Abortion is a crucial healthcare service; it should never be criminalized. I am optimistic about a new future in North Dakota and hope our lawmakers will finally abandon their campaign to impose pregnancy on individuals against their will.”
Ever since Roe was overturned in 2022, numerous women have reported being denied abortion care after experiencing complications, some of which were life-threatening.
In recent years, judges in states such as Wyoming, Utah, and Montana have overruled abortion bans, and voters have repudiated anti-abortion ballot measures while supporting those that uphold the right to abortion in states like Kentucky, Kansas, Ohio, and Michigan.
