In a conclusive report made public by the U.S. Justice Department early Tuesday, the special counsel who prosecuted Donald Trump for his actions to undermine the 2020 election, stated that the former president would have been found guilty of “multiple criminal attempts to maintain authority” if he hadn’t secured another term in the White House in November.
“Were it not for Mr. Trump’s election and his impending return to office, the office determined that the evidence eligible for admission in court was ample to achieve and uphold a conviction at trial,” Jack Smith, who stepped down from the Justice Department late last week prior to Inauguration Day, penned in his report.
Smith highlighted the Justice Department’s stance that “the Constitution prevents the ongoing indictment and prosecution of a sitting president,” a view he described as “absolute and irrespective of the severity of the crimes, the strength of the evidence, or the merits of the case, which the office fully supports.”
Trump’s legal representatives had attempted to suppress the report, which is the initial volume of two that Smith’s team compiled following their investigations into Trump’s illegal election interference and mishandling of classified documents. After Trump’s victory in the 2024 election, Smith closed both cases.
The Justice Department mentioned that Smith has recommended withholding the release of the volume concerning the classified documents investigation to the public while the trial against Trump’s former associates is ongoing.
“Trump collaborated with others to implement a shared strategy: to reverse the election outcome and secure his continuation in office.”
In the recently disclosed report, Smith detailed Trump’s efforts to “pressure state officials to disregard actual vote tallies,” orchestrated “false groups of presidential electors in seven states he lost,” incited “an incensed crowd to the U.S. Capitol to disrupt the congressional certification of the presidential election,” and exploited “the rioters’ violence to further postpone it.”
“To support these actions, Mr. Trump collaborated with others to implement a shared strategy: to reverse the election outcome and secure his continuation in office,” the report further noted.
Trump vehemently responded to the publication of the report, launching a tirade on social media claiming, “Insane Jack Smith failed to successfully prosecute the Political Rival of his ‘boss,’ Crooked Joe Biden, hence he concludes with yet another ‘Report’ based on data that the Unselect Committee of Political Goons and Thugs ILLEGALLY DESTROYED AND DELETED, showing my total innocence and the absolute guilt of Nancy Pelosi and others.”
In the report’s preface, Smith dismissed as “ridiculous” Trump’s accusation that the investigations were politically driven or influenced by the Biden administration.
“Although we could not bring the cases we initiated to trial, I maintain that our team’s defense of the rule of law is significant. I believe the precedent our team established for others to pursue justice, regardless of personal sacrifices, is important,” Smith wrote. “The facts, as we discovered them through our investigation and as presented in my report, are important. Experienced prosecutors understand that outcomes are beyond control; one can only perform one’s duties correctly for the right reasons. I conclude our efforts confident that we have done so, and that we have fulfilled our responsibilities to the department and the nation.”
