Rep. Ro Khanna’s Critique

U.S. Vice President JD Vance faced backlash after a controversial social media post late Tuesday, in which he defended the Trump administration’s handling of due process rights—a constitutional guarantee for all individuals in the U.S., including immigrants currently facing detention and deportation.
In his post on the platform X, Vance, who holds a law degree from Yale University, questioned the role of due process, framing it as a matter of “resources, the public interest, the status of the accused, the proposed punishment, and so many other factors,” rather than a constitutional right.
Vance belittled concerns about due process and argued that legal proceedings for immigrants would overburden the system. He also charged that the Biden administration had allowed “about 20 million” undocumented immigrants into the country, a number that experts have dismissed as unfounded.
New York Times columnist Jamelle Bouie criticized Vance’s post, labeling him “a contemptible liar and a blatant adversary of the Constitution.”
Bouie pointed out, “The main factual assertion here is utterly incorrect, and even if it were correct, the Constitution explicitly includes two due process clauses,” referring to the Fifth and Fourteenth Amendments. He expressed his grave concerns by stating, “I genuinely mean it when I say they loathe our freedoms.”
Journalist Matt Novak commented on the broader implications of denying due process to undocumented immigrants, saying, “If undocumented individuals have no rights to due process, then effectively no one does.”
“Individuals like Vance are aware of this yet remain indifferent,” Novak continued. “If someone can be arbitrarily labeled ‘illegal’ without due process, then anyone can be declared illegal and you lose your right to contest it. It’s a fundamentally simple concept.”

The Trump administration has evidently disregarded due process in its ongoing arrests and deportations of immigrants, without proving their involvement in any crime. A recent Times investigation revealed minimal evidence of criminal activities or gang affiliations among the many men deported to El Salvador last month.
Among the deported was Maryland resident Kilmar Abrego Garcia, now in a notorious Salvadoran prison. Key Trump administration figures, including homeland security adviser Stephen Miller, have argued that Garcia was not entitled to due process.
“The only process he deserved was deportation,” Miller posted on social media.
However, in a landmark 9-0 decision last week, the Supreme Court, dominated by conservative justices, ruled that the Trump administration must “facilitate” Garcia’s return to the U.S. The Court also asserted that “detainees under removal orders [from the Alien Enemies Act of 1798] are entitled to notice and a chance to contest their removal,” directly opposing Vance and other officials’ stance.
Speaking at Vance’s alma mater on Tuesday, U.S. Rep. Ro Khanna (D-Calif.) issued a stern warning about the dangers posed by the vice president’s outright denial of due process rights.
“Without due process, Vance is just as likely to destroy the life of an innocent person as he is to correctly identify the guilty. And his indifference is apparent,” Khanna emphasized. “In Vance’s vision for America, police can target any immigrant, deport them to autocratic regimes without due process, and then absolve themselves of any responsibility, pretending America is powerless to intervene once someone is beyond our borders.”
